NEW VERSION OF THE NICE CLASSIFICATION IN 2026

On January 1, 2026, the 2026 version of the 13th edition of the Nice Classification (NCL 13-2026) will come into force. This classification, used for the registration of trade marks, is published by WIPO (World Intellectual Property Organization) and directly impacts trademark applications and registrations worldwide.

As a reminder, the Nice Classification is the international classification of goods and services for the purposes of trade mark registration and is in force in 96 countries.

 

Here are the key points to remember:

The new classification will apply to all international applications filed from January 1, 2026.

 

Notable Changes

The new classification introduces significant class changes for certain goods and services. Among the most noteworthy:

  • Eyewear: Glasses (prescription, sunglasses, frames, lenses, contact lenses, etc.) are moving from Class 9 to Class 10 (medical devices).
  • Rescue Vehicles: Fire trucks, fireboats, lifeboats, and liferafts are being transferred from Class 9 to Class 12 (vehicles).
  • Other Reclassifications: Some products, such as electrically heated clothing, are moving from Class 11 to Class 25.

  • Check the classification of your goods and services.
  • Update your lists of goods and services to avoid partial refusals or ex-officio actions, which can lead to additional costs.

For already registered trade marks:

  • Identify impacted trade marks and assess whether updates are needed (for example, for international extensions of protection or declarations of use in certain countries).
  • Anticipate renewals by updating the classification of your goods and services no later than the next renewal date.
