{"id":2635,"date":"2019-03-27T09:35:38","date_gmt":"2019-03-27T08:35:38","guid":{"rendered":"https:\/\/www.inscripta.fr\/le-nom-glen-buchenbach-interdit-pour-du-whisky-non-ecossais\/"},"modified":"2020-05-17T18:46:45","modified_gmt":"2020-05-17T16:46:45","slug":"name-glen-buchenbach-banned-for-a-non-scottish-whisky","status":"publish","type":"post","link":"https:\/\/www.inscripta.fr\/en\/trademarks\/name-glen-buchenbach-banned-for-a-non-scottish-whisky\/","title":{"rendered":"Name Glen Buchenbach banned for a non-Scottish whisky"},"content":{"rendered":"<p>[et_pb_section fb_built=&#8221;1&#8243; admin_label=&#8221;section&#8221; _builder_version=&#8221;3.22&#8243;][et_pb_row admin_label=&#8221;row&#8221; _builder_version=&#8221;3.25&#8243; background_size=&#8221;initial&#8221; background_position=&#8221;top_left&#8221; background_repeat=&#8221;repeat&#8221;][et_pb_column type=&#8221;4_4&#8243; _builder_version=&#8221;3.25&#8243; custom_padding=&#8221;|||&#8221; custom_padding__hover=&#8221;|||&#8221;][et_pb_text admin_label=&#8221;Text&#8221; _builder_version=&#8221;4.4.5&#8243; background_size=&#8221;initial&#8221; background_position=&#8221;top_left&#8221; background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243;]<\/p>\n<p>Last August, we spoke about the German whisky \u2018Glen Buchenbach\u2019 (<a href=\"https:\/\/www.inscripta.fr\/en\/toutes\/glen-whisky-ecossais-ou-non\/\">here<\/a>), which caused the preliminary ruling of the 7<sup>th<\/sup> of June of 2018 by the Court of Justice of the European Union in the Case C\u201144\/17, Scotch Whisky Association v Michael Klotz.<\/p>\n<p>The Court of Justice had been asked a series of questions by the Landgericht Hamburg (Regional Court in Hamburg, Germany) related to the interpretation of Article 16(a) to (c) of Regulation (EC) No 110\/2008 of the European Parliament and of the Council of 15 January 2008 on the definition, description, presentation, labelling and the protection of geographical indications of spirit drinks.<\/p>\n<p>The case had been initiated by the Scotch Whisky Association which had taken the view that the marketing of a German whisky under the designation \u2018Glen Buchenbach\u2019 was infringing the geographical indication \u2018Scotch Whisky\u2019.<\/p>\n<p>Following the preliminary ruling of the Court of Justice, the Regional Court of Hamburg issued its decision on February the 7<sup>th<\/sup>, 2019 (case 327 O 127\/16) stating that the use of the word \u2018Glen\u2019 constitutes a false or misleading indication liable to convey a false impression as to the origin of the whisky produced by the Waldhorn distillery in Germany.<\/p>\n<p>Although the designation \u2018Glen Buchenbach\u2019 does not reproduce or imitate the geographical indication \u2018Scotch Whisky\u2019, and although it cannot be considered it would be an evocation of the GI \u2018Scotch Whisky\u2019, the Court of Hamburg judged the word \u2018Glen\u2019 could mislead the consumers.<\/p>\n<p>It would be so because almost all whiskies with the word \u2018Glen\u2019 in their names are Scotch whiskies. As a consequence, consumers might think a whisky named \u2018Glen\u2019 would be a \u2018Scotch Whisky\u2019.
