{"id":2615,"date":"2018-06-29T17:45:53","date_gmt":"2018-06-29T15:45:53","guid":{"rendered":"https:\/\/www.inscripta.fr\/ue-chine-la-bataille-des-transferts-de-technologie\/"},"modified":"2020-04-29T16:11:30","modified_gmt":"2020-04-29T14:11:30","slug":"eu-china-the-battle-for-technology-transfers","status":"publish","type":"post","link":"https:\/\/www.inscripta.fr\/en\/patents\/eu-china-the-battle-for-technology-transfers\/","title":{"rendered":"EU \/ China &#8211; The battle for technology transfers"},"content":{"rendered":"<p>Early June 2018, the European Union has initiated proceedings before the World Trade Organisation against China for failing to respect the intellectual property rights of European companies.<\/p>\n<p>Observing that \u201c<em>European companies coming to China are forced to grant ownership or usage rights of their technology to domestic Chinese entities and are deprived of the ability to freely negotiate market-based terms in technology transfer agreements<\/em>\u201d, the EU decided to take action especially on the grounds of the rules set by the WTO\u2019s Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).<\/p>\n<p>The EU claims that some provisions of the Chinese regulations on technologies transfers discriminate against foreign companies by offering Chinese companies a better treatment.<\/p>\n<p>The EU is clear about its intentions which are safeguarding intellectual and industrial property rights of European companies and assuring better protection for trade secrets.<\/p>\n<p>We will have to wait and see if the WTO will be able to settle the dispute whereas it has been weakened lately, especially by declarations of the Trump Administration.<\/p>\n<p style=\"text-align: center;\">\u00a9 [INSCRIPTA]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Early June 2018, the European Union has initiated proceedings before the World Trade Organisation against China for failing to respect the intellectual property rights of European companies.
